تشدد اور قتل وغارت گری کے اسباب

ہمارا معاشرہ عرصہ دراز سے قتل و غارت گری کی زد میں ہے۔ تشدد اور قتل وغارت کو روکنے کے لیے فوری اور ٹھوس اقدامات کرنا اور اس کے نفسیاتی محرکات کو سمجھنا انتہائی ضروری ہے۔ جب تک نفسیاتی محرکات کا سنجیدگی سے جائزہ نہیں لیا جائے گا اس وقت تک تشدد کی بیخ کنی نہیں ہو سکتی۔
تشدد کا پہلا سبب حد سے بڑھا ہوا تعصب ہے جو کسی انسان کو دوسرے انسان کی زندگی لینے پر آمادہ کر دیتا ہے۔
 مخالفت کے اسباب مذہبی ہوں یا سیاسی، بہر صورت انسان کو دوسرے انسانوں کو زندہ رہنے کا حق ضرور دینا چاہیے۔ یہ بات درست ہے کہ کئی مرتبہ کسی گروہ سے تعلق رکھنے والے کسی شخص یا بعض افراد کا ظلم اخلاق اور مذہب کی حدود سے تجاوز کر جاتا ہے ، لیکن ایسی صورت میں بھی مد مقابل لوگوں کو قانون اپنے ہاتھ میں لینے سے گریز کرنا چاہیے اور ظلم و ستم سے نجات حاصل کرنے کے لیے قانونی چارہ جوئی کرنی چاہیے تاکہ ایک ناانصافی کا بدلہ دوسری ناانصافی سے نہ لیا جائے۔ 
تشدد کا دوسرا بڑا سبب لالچ اور حد سے بڑھی ہوئی خواہشات ہوتی ہیں۔
 جب انسان راتوں رات امیر بننا چاہے تو اس کے لیے ہر جائز وناجائز راستہ اختیار کرتا ہے اور اس حوالے سے کئی مرتبہ دوسرے انسانوں کا خون بہانے سے بھی گریز نہیں کرتا۔ اچھی کوٹھی ، اچھی گاڑی اور وافر سرمائے کی خواہش حد اعتدال سے تجاوز کرجاتی ہے تو انسان کی آنکھوں پر ہوس کی پٹی بندھ جاتی ہے، وہ ہوائے نفس کا اسیر بن جاتا ہے، اس کے لیے حلال وحرام کے درمیان تفریق کرنا ممکن نہیں رہتا۔ ایسا شخص تشدد اور نفرت کے سوداگروں کے لیے خام مال کا کردار ادا کرتا ہے۔ وہ تھوڑا سا بھی سرمایہ حاصل کرنے کے لیے کسی بھی انسان کو قتل کرنے سے گریز نہیں کرتا ۔ وہ شعوری یا لا شعوری طور پر ملک و ملت کے دشمنوں کے ہاتھوں میں کھلونا بن کر اپنے ہی ہم وطن اور ہم مذہب لوگوں کے خون سے اپنے ہاتھوں کو رنگین کر بیٹھتا ہے۔ 
تشدد کا تیسرا بڑا سبب ریاستی قوانین سے بے خوفی ہے۔
 جب کسی انسان یا گروہ کے ذہن میں یہ بات اتر جائے کہ بوقت ضرورت قوانین کوہاتھ میں لیا جاسکتا ہے یا یہ تاثر عام ہو جائے کہ قوانین کا نفاذ معاشرے میںہمہ جہت نہیں ہے تو ایسی صورت میں معاشرے میں لاقانونیت کی حوصلہ افزائی ہوتی ہے۔ ہمارے معاشرے میں ایسے بہت سے واقعات رونما ہو چکے ہیں کہ طاقتور افراد کے ہاتھوں قتل ہونے والے یا ظلم کا نشانہ بننے والے افراد کی داد رسی نہیں ہو سکی۔ اس قسم کے واقعات مستقبل میں لاقانونیت کی بنیاد بن جاتے ہیں ۔ نبی کریم ﷺ قوانین کے ہمہ گیر نفاذ پر بہت زیادہ توجہ دیا کرتے تھے۔ چنانچہ جب بنو مخزوم کی فاطمہ نامی بااثر عورت نے چوری کی تو آپﷺ نے ارشاد فرمایا تھا کہ اگر میری بیٹی فاطمہ بھی چوری کرے تو میں اس کے بھی ہاتھ کاٹ ڈالوں گا۔ آپ ﷺ نے سابقہ اقوام کی تباہی کے ایک بڑے سبب کو بھی بیان فرمایا تھا کہ جب ان میں سے چھوٹے لوگ جرائم کا ارتکاب کرتے تو ان کو سزا دی جاتی اورجب بڑے لوگ ظلم کرتے تو انہیں چھوڑ دیا جاتا۔ تشدد کا ایک اور اہم سبب معاشی ناہمواریاں بھی ہیں ۔انسانوں کی بنیادی ضروریات کا انتظام کرنا ریاست کی ذمہ داری ہے۔ جب عوام کی بڑی تعداد سطح غربت سے نیچے زندگی بسر کر رہی ہو اور بنیادی سہولیات کی فراہمی کا کوئی راستہ نظر نہ آئے تو انسان اپنی ضروریات کو پورا کرنے کے لیے اخلاقیات اور مذہب کی تمام پابندیوں کو پامال کر دیتا ہے ۔ بہت سے یورپی ممالک میں سماجی تحفظ اور انصاف کا ایک ایسا نظام موجود ہے‘ جس کے تحت کسی بھی انسان کو روٹی ، کپڑا ، مکان اور علاج ومعالجے کی سہولیات کے حصول کے لیے تکلیف اور تردّد کا سامنا نہیں کرنا پڑتا۔ چنانچہ لوگ چھیناجھپٹی، لوٹ مار اور تشدد کی طرف مائل نہیں ہوتے۔ جب معاشی ناہمواری اور محرومی حد سے بڑھ جاتی ہے تو انسان اپنے حقوق کے حصول کے لیے منفی راستوں کو اختیار کر لیتا ہے۔ معاشی طور پر محرومیوں کا شکار انسان پرتشدد سرگرمیوں کی طرف مائل ہوجاتا ہے اور اگر اس کو کوئی اپنے منفی مقاصد کے لیے استعمال کرنا چاہے تو وہ فی الفور آمادہ و تیار ہو جاتا ہے ۔
تشدد کا ایک اہم سبب میڈیا کا غیر ذمہ دارانہ روّیہ بھی ہے۔
لڑائی جھگڑے پر مبنی مواد کوبکثرت میڈیا پر دکھایا جاتا ہے۔ کئی مرتبہ ایسے ڈرامے اور فلمیں بنائی جاتی ہیں جن میں غنڈوں کو ہیرو کے روپ میں پیش کیا جاتا ہے۔ پر تشدد مناظر دیکھنے والے نوجوانوں کی نفسیات مسخ ہوجاتی ہے اور وہ جلد یا بدیر غیر معمولی کردار کے حامل ہیرو کے روپ میںنظر آنے کی کوشش کرتے ہیں ۔ مغربی ممالک میں کئی ایسے واقعات رونما ہو چکے ہیں کہ جہاں بگڑے ہوئے نوجوانوں نے بغیر کسی وجہ کے بڑے پیمانے پر سکول وکالج اور دیگر مقامات پر بے گناہ لوگوں کو موت کے گھاٹ اتار دیا۔
تشدد کا ایک اور اہم سبب مذہب سے دوری بھی ہے۔
 مذہب انسان کو صبر و تحمل اور بردباری کا درس دیتا ہے۔ مذہب سے بیزار انسان ان صفات سے عاری ہوتا ہے، وہ صبر و تحمل اور برد باری کے اجر و ثواب سے نا واقف ہونے کے سبب انتقام اور غصے سے مغلوب ہو کر تشدد پر اتر آتا ہے۔ قرآن مجید نے ہمیں بتلایا کہ حضرت یوسف علیہ السلام اپنے بھائیوں کے حسد کا نشانہ بنے اور بھائیوں نے ان کو تاریک کنویں میں اتار دیا۔ حضرت یوسف علیہ السلام کو بھائیوں کی بے مروّتی کی وجہ سے زندگی میں بہت سی آزمائشوں کا سامنا کرنا پڑا۔ طویل عرصہ گزرنے کے بعد اللہ تعالیٰ نے آپ کو اقتدار عطا فرمایا اور وہ وقت بھی آیا جب بھائی آپ کے رحم وکرم پر تھے۔ حضرت یوسف علیہ السلام اگر چاہتے تو ان سے انتقام لے سکتے تھے لیکن انہوں نے انتقام لینے کے بجائے ان سب کو معاف کر دیا ۔
اسی طرح حضرت رسول اللہﷺ کو کفار مکہ کی مخالفت کا سامنا کرنا پڑا ۔ انہوں نے آپﷺ کو ہر طرح کی اذیتیں اور تکالیف دیں، آپ ﷺکے وجود اطہر پر پتھر برسائے، آپﷺکے راستے میں کانٹے بچھائے، آپ ﷺکے گلوئے اطہرمیں چادر ڈال کر کھینچا گیا، آپ کا سماجی بائیکاٹ کیا گیا، یہاں تک کہ آپ کو ہجرت پر بھی مجبور کر دیا۔ قیام مدینہ کے دوران بھی آپﷺ پر جنگیں مسلط کی گئیں۔ پھر وہ وقت بھی آیا جب آپﷺ فاتح کی حیثیت سے مکہ مکرمہ میں داخل ہوئے۔ آپﷺ کفار مکہ سے انتقام لے سکتے تھے لیکن آپﷺ نے ظلم وبربریت کا مظاہرہ کرنے والے تمام لوگوں کو معاف کر دیا۔ 
تشدد کا ایک اور اہم سبب معاشرے میں سیاسی انتشار اور عدم استحکام بھی ہے۔ سیاسی کشمکش کی وجہ سے کئی مرتبہ رہنماؤں کے درمیان گرم وسرد بیانات کا تبادلہ ہوتا ہے۔ اس دوران رہنما ایک دوسرے پر جھوٹ، فریب، دغابازی اور لوٹ مار کے الزامات بکثرت لگاتے ہیں۔ ان الزامات کی وجہ سے معاشرے میں نفرتیں جنم لیتی ہیں ۔ ماضی میں بنگالی اور غیر بنگالی تنازع نے اتنا طول پکڑا کہ ملک دو لخت ہوگیا۔ اسی طرح قومی اتحاد کی تحریک میں بھی پورا معاشرہ تشدد اور نفرت کی بھینٹ چڑھ گیا تھا۔ 
2013 ء کے انتخابات کے بعد بھی معاشرے میں سیاسی افراتفری پورے عروج پر رہی۔ درجنوں کی تعداد میں لوگ اس سیاسی افراتفری کی بھینٹ چڑھ چکے ہیں ۔ تشدد کی روک تھام کے لیے کوئی بھی موثر حکمت عملی تیار کرتے ہوئے ارباب ریاست وسیاست کو ان محرکات کا جائزہ ضرور لینا چاہیے جو تشدد پر منتج ہوتے ہیں۔ ان محرکات کو نظر انداز کرکے اگر کوئی پالیسی تیار کی گئی تو یہ تشدد کے دیر پا  خاتمے کے لیے موثر اور کارگرنہیں ہو سکے گی

دہشت گردی کا ایک اہم پہلو سماجی اور ثقافتی بحران بھی ہے۔ ایک طرف غریب طبقات کے بچے کالے دھن کی اس آگ کا ایندھن بنتے ہیں تو دوسری جانب متوسط اور بالادست طبقات کے نوجوان جس معاشرتی اور ثقافتی پراگندگی اور ابہام کا شکار ہیں، وہ ان کی نفسیات کو جنون اور وحشت میں دھکیل دیتا ہے۔ ایسا گزشتہ کچھ عرصے کے دوران کئی واقعات کی تفتیش کے دوران واضح ہوا۔ متوسط اور بالادست طبقات کے ایسے افراد یا تو بنیاد پرستی اور دہشت گردی میں براہ راست ملوث ہو جاتے ہیں‘ یا پھر بالواسطہ طور پر مالی وسائل اور سہولیات فراہم کرتے ہیں۔
اس نظام کے اقتصادی‘ سماجی‘ ثقافتی اور نفسیاتی بحران کی بیماریاں پورے معاشرے کو لپیٹ میں لئے ہوئے ہیں۔ بنیاد پرستی، مذہبی جنون اور دہشت گردی جیسے کینسر کا علاج اب گہری جراحی کا متقاضی ہے۔ سکیورٹی انتظامات، آپریشن، نئے نئے سکیورٹی ادارے اور پولیس فورسز وغیرہ جیسی شعبدہ بازیوں کے نتائج آج سب کے سامنے  ہیں۔ حقیقی وجوہ اس گلے سڑے اور تعفن زدہ سرمایہ دارانہ نظام میں تلاش کرنے کی ضرورت ہے۔

احمد جاوید ایک حیران کن آدمی ہیں، پاکستان کے دو تین جینوئن دانشوروں میں ان کا شمار کیا جا سکتا ہے۔ قدیم و جدید علوم سے انہیں استفادہ کا موقعہ ملا۔ مولانا ایوب دہلوی جیسے عبقری عالم دین اور متکلم سے انہیں دینی اصول و اسلوب سیکھنے کو ملے۔ سلیم احمد جیسے لیجنڈری ادیب اور دانشور سے برسوں ان کی نشستیں رہیں۔ دراصل یہ پروفیسر محمد حسن عسکری کا سکول آف تھاٹ تھا، جسے سلیم احمد نے قابل قدر اضافوں کے ساتھ آگے بڑھایا۔
 احمد جاوید  صوفی بھی ہیں، فلسفہ پر لیکچر بھی دیتے ہیں، اقبال اکیڈمی سے برسوں تک بھی وابستہ رہے۔ اعلیٰ درجے کے شاعر بھی ہیں۔  خوش قسمتی سے احمد جاوید کا پوسٹ ماڈرن ازم کے حوالے سے ایک لیکچر مل گیا، موضوع گویا پانی ہوگیا۔
احمد جاوید نے اس انٹرویو میں کئی نہایت خوبصورت اور فکر افروز باتیں کہی ہیں۔

 پاکستانی سماج کے انحطاط کا ذکر کرتے ہوئے وہ کہتے ہیں:

 ''ہمارا سب سے بڑا اجتماعی مرض یا ام الامراض یہ ہے کہ ہم گھٹیا لوگ بن کر رہ گئے ہیں۔ ذوق میں، فہم میں، ذہن میں، اخلاق میں... ہر معاملے میں ہم اوسط سے نیچے ہیں۔ یہ ہمارے انحطاط کا سب سے بڑا سبب ہے اور اسی سے ذہنی اور اخلاقی انحطاط پیدا ہوا۔
 ہم بہت چھوٹے لوگ ہیں اور اس چھو ٹے پن کو دور کرنے کی خواہش بھی نہیں رکھتے، اپنے معمولی پن سے نکلنے کی کوئی طلب نہیں رکھتے۔ معمولی پن پیدا ہو جانا مرض ہے، مگر اس معمولی پن، گھٹیا پن پر راضی ہو جانا موت ہے‘‘۔

 احمد جاوید سے سوال پوچھا گیا کہ:
 ہمارے معاشرے میں قحط الرجال کیوں ہے، کوئی بڑا ادیب پیدا ہو رہا ہے، بڑا شاعر نہ بڑا عالم دین؟

 دانشور کا جواب بڑا صاف اور قطعی تھا:
 ''بڑے لوگ پیدا نہ ہونے کا سبب وہی ہے کہ ہم مجموعی طور پر اوسط سے بھی نیچے درجے کی قوم بن چکے ہیں۔ جب تک ہم اپنی کمزوریوں کی ذمہ داری غیروں پر ڈالتے رہیں گے، اس وقت تک ہم ان کمزوریوں سے نکل نہیں سکتے۔
 ہمارا پورا نظام تعلیم عمومی لوگ پیدا کرنے کی مشین ہے۔ سمجھنے کی بات یہ ہے کہ ہر تہذیب کا ایک ذہن ہوتا ہے جو اس کے نظام تعلیم سے تشکیل پاتا ہے۔ اگر کسی معاشرے یا سماج کا نظام تعلیم اس کے اپنے تصور علم سے مناسبت نہ رکھتا ہو اور مانگے تانگے پر مبنی ہو تو ظاہر ہے اس تعلیمی نظام سے اس تہذیب کے اجتماعی شعور کو تقویت نہیں ملے گی‘‘۔

 آگے جا کر احمد جاوید صاحب نے ایک دلچسپ تھیسس پیش کیا ہے۔ کہتے ہیں:

How India is split over BJP's Narendra Modi

India's marathon general election appears to have split the country politically into two halves - people who support and oppose Narendra Modi, the controversial prime ministerial candidate of the main opposition Bharatiya Janata Party, writes journalist Madhuker Upadhyay.

This is probably the first time that a general election in India is centred around one personality who is loved and loathed in equal measure.
Mr Modi, who has been chief minister of the western state of Gujarat since 2001, is seen as a dynamic and efficient leader who has made his state an economic powerhouse.
But he is also accused of doing little to stop the 2002 religious riots when more than 1,000 people, mostly Muslims, were killed - allegations he has consistently denied.
Those who believe in Mr Modi paint him as a messiah, while the non-believers are convinced that he is a divisive figure that India's diverse society cannot afford. They see this split as the vindication of their argument.
'Unstoppable wave'
The believers say there is an "unstoppable wave" in favour of Mr Modi.
A large section of the mainstream media has helped fan this perception, covering his energetic campaign with considerable enthusiasm. Opinion polls have also contributed to the feeling by predicting a veritable sweep for Mr Modi and the BJP, and the decimation of the ruling Congress party.
But many find it difficult to accept that there is a "wave" in favour of Mr Modi, making it a presidential style election in a parliamentary democracy.
They say voting behaviour in India is still determined by caste, class, religion and regional aspirations, among other things.
On an assignment for the BBC Hindi Service, I recently travelled 7,000km (4,349 miles) though nine states and three centrally-administered territories hugging India's vast coastline.
I visited the states of Gujarat, Maharashtra, Goa, Karnataka, Kerala, Tamil Nadu, Andhra Pradesh, Orissa and and West Bengal. The centrally administered territories I went to included Daman and Diu, Dadra and Nagar Haveli and Pondicherry.
In Gujarat, Mr Modi's fief, I found the near-total support for the leader remarkable.
Question Mr Modi's record as an administrator or the much vauntedGujarat growth model which has apparently vaulted it to one of India's most economically prosperous states and you are met with disbelief: "Don't you know it?" his supporters ask. "Haven't you seen it? Are you blind?"
Mr Modi does not need any posters, banners or billboards in Gujarat to prop up his image. His supporters say his work speaks for itself. Many here call him God.
But as one travels southwards from Gujarat, the non-believers seem to gain ground.
Change of mood
Brand Modi, as his image managers fondly call the leader, has reached the street corners of southern states like Kerala and Tamil Nadu. But how much of this awareness will translate into votes and parliamentary seats is a key question.
In the western coastal states of Maharashtra and Karnataka - both once ruled by the BJP - other factors are playing on the minds of voters.
While local issues and strong regional parties in Maharashtra pose a challenge to the BJP, allegations of corruption against the BJP government and caste politics may well make it difficult for the party to do well in Karnataka.
Apart from Gujarat, the only other state ruled by the BJP on India's west coast is Goa. With just two parliament seats, Goa recently saw a political change of mood with the local Catholic church making an open appeal to voters to support secular parties.

On the eastern coast too, the non-believers appear to be in a majority.
Politics in the bifurcated state of Andhra Pradesh and Orissa is generally centred around local issues and politicians. In West Bengal, the regional Trinamul Congress party led by the mercurial Mamata Banerjee is in a strong position.
And the three centrally-administered territories with one seat each may change hands but that would be for reasons other than a pro-Modi sentiment.
Interestingly, the nine states on the coast account for 269 of the 543 parliamentary seats. That's just three seats short of a simple majority needed to win the election.
But as this region does not appear to be in the grip of a "wave" in favour of Mr Modi-led BJP and his 25-party alliance, analysts say to win the election, the BJP would need to win at least 200 of the remaining 274 seats.
So when votes are counted on 16 May, they don't rule out a hung parliament with no party or alliance getting a clear majority.
This is a prospect which will not cheer the believers, and befuddle the non-believers.

Every religion has a certain group of` people who believe that over a period of time, religion becomes distorted, polluted and misinterpreted as a result of` which, it loses its originality, purity and simplicity.
These people then make it their mission to revive the original teachings of religion and implement them to reform the society.

Since they believe that innate human nature leads man to a sinful life; evil must be thus eliminated from the society and people must be led to the righteous path and their wrong doings corrected using coercive methods and severe punishment.

To implement their religious ideals, these groups struggle to capture state power and then use it to transform society according to their particular vision.

History has several examples of individuals who, gripped with religious fervour and zeal and desirous of accomplishing their ideas, strove to seize power and implement their agenda. The followers of these religious movements claim to be `rightly guided people,` assigned by God to convert the world into a `religious utopia` so that everyone would strictly follow divine commands.

One example of this breed is Savonarola (d.1498), the Florentine priest who was a fiery speaker and a religious extremist. He attacked the authority of the church and the spiritual power of the Pope. He condemned corruption and irreligious innovation which he believed had disfigured the teachings of Christianity. In doing so, he won the support of a group of young followers with whom he shared his views of societal change. With their help, he attained the political power needed to implement his religious ideas. He also promulgated a set of laws intended to make a `new Jerusalem` out of Florence. He proposed that exile and capital punishment should be abolished. He wanted Florence to become a glorious, peaceful and prosperous state.

Savonarola also introduced moralistic laws against sodomy, consumption of alcohol, `immodest` attire and `immoral` practices. Young people who followed him patrolled the street and public places to maintain and monitor a strict check on people, a formula that many similar zealots have also followed.

After enduring Savonarola for some time, Pope Alexander invited him to Rome but Savonarola refused to oblige him and continued to deliver his fiery sermons. Finally, the Pope excommunicated him and asked the political authorities of Florence to take action against him. Savonarola was arrested, put on trial and condemned to death. He was publicly burned at stake in the city square in Florence; bringing his short-lived religious utopia to an end.

Another attempt to implement religious ideas was made in Geneva by John Calvin (dl564) who broke away from the Catholic Church and established the Calvinist sect. He was invited by the authorities in Geneva to come and set up a religious utopia in the city based on his religious beliefs and teachings. After assuming political power, he was in a position to implement his religious agenda. As a first step, he exiled people who disagreed with him while those in favour of his beliefs were allowed to stay and observe his laws. In case of refusal, they would be excommunicated from the church, exiled from the city, imprisoned and even awarded the death penalty.

His legislation included prohibition on feasts, dancing, singing, pictures, statues, relics, church bells, organs, altar candles; `indecent or irreligious` songs, staging or attending theatrical plays; jewelry, lace, or `immodest` dress; extravagant entertainment; swearing, gambling, playing cards and hunting.

Traders and shopkeepers involved in adulteration or weighed less were severely punished. The Bible was made available everywhere. Laughing during religious services was regarded as a sin. Every citizen was required to thank God before eating, and those who deviated from these repressive laws were severely punished. During the six years of his rule, 150 heretics were burnt alive. Eventually, the citizens of Geneva became fed up of this religious totalitarianism and conflicts arose, Calvin was exiled and the old political, social and religious order of the city was restored.

In the subcontinent, Syed Ahmad Shaheed and his zealous followers leda jihad movement, the Tariyah-iMuhhamadiyah, and founded an Islamic state in what is today known as Khyber Pakhtunkhwa. He declared himself caliph and Amir-ul-momineen.

He introduced strict Islamic laws according to the Wahabi interpretation.

Those who protested or refused to abide by these severe strictures were severely punished. Eventually tiring of his fundamentalist religious policies, the Pathans rebelled against him and expelled his followers from Peshawar.

He and most of` his disciples were killed in the battle of Balakot in 1832.
Extremists are resented because they forbid people from enjoying even simple entertainment and merry-making while enforcing a strict code whereby people are required to remain fearful and remorseful; focusing purely on the life after death. According to them, people should devote their entire lifetime to the salvation of the soul. Instead of thinking about this world, they should regard the next world as their final and permanent abode. Unsurprisingly, most people aren’t willing to submit to this kind of rule, except under duress. Anti-Muslim violence in India has occurred periodically since the country's partition in 1947, frequently in the form of mob attacks on Muslims by Hindus. Such attacks, often referred to as "communal riots" in India, are part of a pattern of sporadic sectarian violence between the Hindu and Muslim communities, which has been connected to a rise in anti-Muslim sentiment throughout the 20th century Most incidents have occurred in the northern and western states of India, whereas communalist sentiment in the south is less pronounced. Among the largest incidents were Bihar in 1946,[5] Nellie in 1983 and Gujarat in 2002.
According to political scientists, organizations with roots in Hindu nationalism have played a large part in these incidents of anti-Muslim violence, and in generating anti-Muslim sentiment. In particular, organizations associated with the Rashtriya Swayamsevak Sangh, such as the Bharatiya Janata PartyVishwa Hindu Parishad and Bajrang Dal are all considered by scholars to have a central role in the violence. The BJP, and its predecessor the Jana Sangh, have used these communal riots and anti-Muslim propaganda as a part of a larger political strategy. These incidents of violence against Muslims have marred India’s post independence history with a spill-over effect on India’s cause in the Kashmir conflict.
Hindu right-wing politicians will often legitimize instances of mass violence against Muslims as a natural reaction to actions perpetrated by Muslims in the past and the present. However, these patterns of violence have been well-established since partition, with dozens of studies documenting instances of mass violence against minority groups. Over 10,000 people have been killed in Hindu-Muslim communal violence since 1950. According to official figures, there were 6,933 instances of communal violence between 1954 and 1982 and, between 1968 and 1980, there were 530 Hindus and 1,598 Muslims killed in a total of 3,949 instances of mass violence.

The following are the highlights of the Prevention of Communal and Targeted Violence Bill, which the government said will be tabled during the winter session of parliament. 



  • The words "majority" and "minority" community have been removed from the bill. 
  • The Centre does not override state nor hit the federal structure but has a more of a coordinating role, government sources said. 
  • Earlier, the Centre could rush forces on its own to communally disturbed areas, but now it can do so only if the state concerned demands additional paramilitary forces. 
  • The bill flags dereliction of duty by a public servant to ensure that they don't remain mute spectators to any such incident. 
  • Acts of omission or commission are both punishable in the bill if officials fail to act or interfere or incite, or lead to worsening of situation. 
  • The bill defines organised communal violence saying it will include continuing unlawful activity of a systematic nature having a particular religious and linguistic identity done by an individual or jointly with others or being part of an association.
  • The bill talks about offences for breach of command responsibility if an officer fails to exercise control over his subordinates. 
  • It says that whoever being a public servant or with acquiescence of a public servant intentionally inflicts pain or suffering whether mental or physical, inflicts communal violence. 
  • The bill states that competent authority will be the one designated by a state government or a district magistrate or commissioner of police. 
  • The bill details punishment of three years with fine for hate propaganda and life term for organised communal violence. 

  • It suggests three years jail plus fine for financially aiding such violence and recommends jail for 2-5 years for dereliction of duty by an officer. 
  • There is also a provision for compensation of Rs.7 lakh in case of death, Rs.5 lakh in case of rape, and Rs.4 lakh in case of sexual assault, the state has to pay in case of communal riots.
